1. Agreement and eligibility
These Terms govern escapescenario.com and related Escape Scenario services (the "Service"). The Privacy Policy and, when applicable, the Refund and Cancellation Policy are incorporated into and form part of these Terms. By creating an account, checking an acceptance box when available, completing a purchase, or accessing or using the Service after these documents are conspicuously presented or linked, you agree to these Terms and acknowledge the Privacy Policy and applicable Refund and Cancellation Policy. If you use the Service for an organization, you represent that you have authority to act for it.
Facilitator accounts are intended for people age 18 or older. Participants may join without an account. A minor may participate only with appropriate permission and adult or organizational supervision. The ordinary public Service is not intended for children under 13.
2. Service and safety
Escape Scenario provides fictional, facilitator-led learning and team-development activities. Scenarios, reference orders, explanations, scores, and reports are educational activity materials, not emergency, medical, psychological, legal, scientific, cybersecurity, workplace-safety, or other professional advice. They do not certify competence or measure intelligence, personality, employability, academic ability, leadership potential, mental health, or professional fitness.
Do not use the Service during a real emergency or to make a high-impact decision about employment, education, credit, insurance, health care, housing, legal rights, or safety. Do not turn a scenario into a physical challenge or unsafe reenactment.
3. Accounts, links, and facilitator responsibilities
Provide accurate account information, protect credentials and devices, and report suspected unauthorized access. Room codes and join, operator, presentation, recovery, reconnect, and recap links may grant scoped access. Share them only with intended recipients and do not publish them.
Facilitators are responsible for selecting an appropriate audience and setting; providing required notice, permission, and supervision; using non-identifying nicknames; avoiding unnecessary sensitive information; offering a reasonable way to pause, skip, or leave; protecting access and result links; addressing harassment or unsafe conduct; and presenting scores as discussion aids rather than validated assessments.
4. Plans, payments, and cancellation
Available plans, prices, capacities, discounts, and features are shown on the pricing or checkout page and may change prospectively. The server, not browser text, screenshots, client-side flags, or a payment-success page, determines access, capacity, discounts, Event Pass activation, and usage.
A 24-hour Event Pass is a one-time, capacity-based product. Its window begins at the first successful server-authorized activity launch, not during preparation or lobby check-in. Eligible sequential sessions may begin while the window is active, subject to the purchased capacity and one live room at a time.
Pro is a monthly or annual recurring plan. When paid checkout is enabled, checkout will disclose the price, renewal interval, material limits, refund terms, and cancellation method before charging you. Pro renews until canceled. You may cancel online; cancellation stops future renewals and normally takes effect at the end of the current paid period.
The Refund and Cancellation Policy and purchase-specific disclosures are part of these Terms. Paid checkout will remain disabled until server-verified fulfillment, online cancellation, refund handling, support, and transaction reconciliation are operational.
5. Acceptable use
You may not use the Service unlawfully or deceptively; harass, exploit, or expose another person; upload malware or content you lack permission to use; seek unauthorized access to accounts, rooms, protected answers, private content, results, or administration; bypass security, capacity, payment, phase, or rate-limit controls; impersonate another person; scrape or reverse engineer except where law permits despite this restriction; resell access; use the Service to build a competing product; collect unnecessary regulated information; or use scenarios as real emergency guidance or unsafe physical activities.
6. Content and intellectual property
Escape Scenario and its licensors retain all rights in the Service, software, designs, trademarks, scenarios, protected reference materials, and other content. Subject to these Terms, you receive a limited, revocable, non-transferable right to use the Service for authorized internal facilitation, education, and team development. You may not publish, resell, systematically extract, or commercially redistribute protected materials without written permission.
You retain ownership of content you lawfully submit. You grant Escape Scenario a limited license to host, process, secure, display, and preserve it as needed to provide the selected private or approved workflow. You are responsible for having the necessary rights and for not submitting confidential, unlawful, infringing, or unnecessary personal information. Public creator submissions are not included in the initial commercial Service. Escape Scenario may, at its discretion, introduce creator submissions, publishing tools, and a creator marketplace in the future under additional terms governing review, publication, licensing, moderation, and removal.
7. Availability, suspension, and termination
The Service depends on third-party hosting, authentication, database, storage, email, payment, and network providers. Escape Scenario may maintain, modify, suspend, or discontinue features; correct errors; change scenario availability; and impose reasonable security or operational limits. We do not promise uninterrupted operation, 24/7 support, or suitability for every event, organization, or device.
You may stop using the Service and may request account closure through support@escapescenario.com. Escape Scenario may restrict, suspend, or terminate access to address nonpayment, security risk, harm, legal obligations, or material or repeated violations. When practical, we will provide notice and an opportunity to cure; urgent action may be immediate.
8. Disclaimers, liability, and organizational responsibility
To the maximum extent permitted by law, the Service is provided "as is" and "as available," without implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement. Escape Scenario does not warrant that a scenario reference is the only defensible real-world answer or that the Service meets every legal, accessibility, security, procurement, or device requirement.
To the maximum extent permitted by law, Escape Scenario and its owners, personnel, contractors, licensors, and providers are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, data, or business interruption. Aggregate liability for claims related to the Service will not exceed the greater of the amount paid for the Service during the 12 months before the event giving rise to the claim or US $100. Non-waivable rights and liabilities are not limited.
To the extent permitted by law, an organization using the Service is responsible for its facilitation, invitations, exported results, and violations of another person's rights, and will indemnify Escape Scenario against resulting third-party claims except to the extent caused by Escape Scenario's own breach, negligence, or unlawful conduct.
9. Informal resolution, individual arbitration, and class-action waiver
Before starting arbitration or filing a claim, contact support@escapescenario.com with the subject "Legal Notice" and make a good-faith effort for 30 days to resolve the matter informally. This requirement does not prevent either party from seeking urgent temporary or injunctive relief or bringing an eligible individual claim in small-claims court.
Except for an eligible individual small-claims matter or a request for temporary or injunctive relief concerning unauthorized access, misuse, or intellectual-property rights, any dispute arising out of or relating to the Service, these Terms, the Privacy Policy, the Refund and Cancellation Policy, or a purchase will be resolved by binding arbitration on an individual basis. The arbitration will be administered by the American Arbitration Association ("AAA") under its then-current Consumer Arbitration Rules and Mediation Procedures. If the AAA is unavailable or declines to administer the matter, the parties will use a mutually agreed substitute, or a court with authority may appoint one. The arbitrator may award the same individual relief a court could award, subject to these Terms and applicable law.
You and Escape Scenario waive the right to a jury trial and agree not to bring or participate in a class, collective, consolidated, or representative action, to the extent permitted by law. If a court determines that a particular claim or remedy cannot lawfully be arbitrated or that a particular waiver is unenforceable, only that claim, remedy, or waiver will be separated and the remainder of this section will continue to apply. Mandatory consumer rights and other non-waivable rights remain available.
You may opt out of this arbitration agreement by emailing support@escapescenario.com with the subject "Arbitration Opt Out" within 30 days after you first accept these Terms. Include the email address associated with your account and a clear statement that you are opting out. Opting out does not affect the rest of these Terms.
These Terms, the Privacy Policy, the Refund and Cancellation Policy, and purchase-specific disclosures are the agreement about the Service. More specific purchase terms control for that purchase. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remainder will continue. Failure to enforce a provision is not a waiver.
10. Changes and contact
Escape Scenario may update these Terms prospectively. We will post the new effective date and provide additional notice or renewed acceptance when required or when a change is material.
